Todd M. Gaynor, Esquire

Mr. Gaynor’s litigation experience includes several areas of the law with a special focus on labor and employment law. He has represented employers, employees and unions in federal and state court, mediation and arbitration and before numerous state, federal and local administrative agencies. In the courtroom, Mr. Gaynor has defended and prosecuted violations of various state employment laws involving wrongful discharge and unfair competition. He has further litigated matters involving numerous federal statutory schemes including the Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), Family and Medical Leave Act (FMLA), Fair Labor Standards Act (FLSA), Employee Retirement Income Act (ERISA), and Title VII of the Civil Rights Act. In administrative settings, Mr. Gaynor has advocated before the Equal Employment Opportunity Commission (EEOC), Virginia Employment Commission (VEC), the Merit Systems Protection Board (MSPB) and the Virginia State Employee Grievance Employment Dispute Resolution Center.

Mr. Gaynor has also counseled employers on how to avoid legal disputes in the workplace involving race and gender discrimination, employee benefits, harassment, retaliation, and wage and hour laws. In addition, he has experience drafting employment contracts, non-compete covenants, severance agreements and employee handbooks that both inform employees of their rights and protect employers from incurring needless legal expenses in the future.

He is listed in Virginia Super Lawyers “Rising Stars” in Employment Law for 2009, 2010, 2011 and 2013  as well as Hampton Roads “Legal Elite.”
